By accessing this website, you are agreeing to be bound by these Terms and Conditions (“Terms”) in a legally binding agreement between us (“Merchant”, “us”, “we”, or “our”) and the User (“you” or “your”). Please read these Terms carefully before accessing or using the Platform. If you do not agree to the Terms, you may not access the Platform. We reserve the right to update and change these Terms by posting updates to the Platform. You are advised to check these Terms from time to time for any updates or changes. If such amendments are not acceptable to you, we advise you to cease using the Platform at that time.
1. Acceptance of Terms
By accessing and using GiftBooks (the “Website” and “Service”), you accept and agree to be bound by these Terms. If you do not agree to abide by the above, please do not use this service.
2. Eligibility
You hereby represent and warrant that you have the right, power, and authority to agree to these Terms, to become a party to a legally binding agreement, and to perform your obligations hereunder. By using this Platform, you confirm that you are at least 18 years of age or are accessing the Platform under the supervision of a parent or legal guardian.
3. Definitions
“Payment Instrument” includes credit card, debit card, bank account, prepaid payment instrument, Unified Payment Interface (UPI), Immediate Payment Service (IMPS), or any other methods of payment developed or deployed by banks and financial institutions from time to time.
“Platform” refers to giftbooks.co.in — the website where GiftBooks offers its products and services and where Transactions may be initiated.
“Transaction” shall refer to the order placed by the User with GiftBooks to purchase the products and/or services listed on the Platform by paying the Transaction Amount.
“Transaction Amount” shall mean the amount paid by the User in connection with a Transaction.
“User” / “Users” means any person availing the products and/or services offered on the Platform.
“Payment Gateway” refers to Instamojo (www.instamojo.com) and/or any other payment gateway integrated by GiftBooks from time to time to facilitate Transactions.
4. Service Description
GiftBooks provides a service to create, illustrate, print, and deliver personalized children's storybooks. Our service includes:
- •AI-generated stories personalized for your child
- •AI-generated illustrations matching the story
- •Professional printing on premium paper
- •Shipping and delivery across India
5. AI-Generated Content
Content Generation: All stories are AI-generated and unique to each customer. No two books will have identical content.
Illustrations: All illustrations are AI-generated. We transparently disclose this in our service description.
Intellectual Property: Once purchased, the AI-generated story and illustrations are licensed to the customer for personal use. You may not commercially reproduce or sell the content.
Quality: While we strive for quality, AI generation may occasionally produce unexpected results. We reserve the right to regenerate content if it fails quality standards.
6. Orders & Payment
Payment Gateway: GiftBooks processes payments through Razorpay. By completing a Transaction, you also agree to Razorpay's terms of service available at www.razorpay.com.
Accepted Instruments: We accept UPI, credit/debit cards, net banking, and other Payment Instruments enabled through Razorpay.
Accurate Payment Information: You agree to provide true, complete, and up-to-date information about yourself as required for completing Transactions. This includes personal details (name, email, phone, delivery address, age, gender) as well as accurate payment information.
Order Confirmation: You will receive an order confirmation with a unique Order ID. This ID is required for tracking and inquiries.
Merchant Rights: We may collect, store, and share information provided by you in order to deliver the products and/or services availed on our Platform and/or contact you in relation to the same.
Payment Disputes: Any payment disputes must be reported within 7 days of transaction. We will investigate and resolve within 14 days.
7. Pricing
Currency: All prices are in Indian Rupees (INR).
GST: Storybooks fall under HSN code 4901 (Books, brochures, printed materials) and are exempt from GST under the GST Act.
Transparent Pricing: All prices are displayed upfront. There are no hidden charges. Additional costs (shipping, add-ons) are clearly itemized at checkout.
Price Changes: Prices are subject to change without notice. You will be informed of the applicable price before payment.
8. Shipping & Delivery Policy
You hereby agree that the delivery dates provided are estimates only, unless a fixed date for delivery has been expressly agreed upon in writing. The cost of delivery shall be calculated at the time of initiating the Transaction based on your shipping address and will be collected as part of the Transaction Amount paid for the products and/or services.
In the event that you do not receive your delivery even after 7 (seven) days have passed from the estimated date of delivery, you must promptly reach out to us at support@giftbooks.co.in or via WhatsApp at +91 70759 69318 so we can investigate and resolve the issue with our logistics partner.
Additional Shipping Details
- •Estimated Timeline: Standard delivery is 5–8 business days across India. Express options may be available as add-ons at checkout.
- •Service Area: We currently deliver across India. International shipping is coming soon.
- •Tracking: All orders come with a tracking ID. You can track your order using your Order ID on our tracking page or via the courier's website.
- •Accurate Address: You are responsible for providing a complete and accurate delivery address. We are not liable for delays or non-delivery caused by incorrect address information.
9. Cancellation & Refund Policy
Upon completing a Transaction, you are entering into a legally binding and enforceable agreement with us to purchase the product and/or service. After this point, the User may not cancel the Transaction unless cancellation has been specifically provided for on the Platform, in which case cancellation will be subject to the terms mentioned on the Platform. We retain sole discretion in approving any cancellation requests and may ask for additional details before approving any such requests.
Refund Eligibility
Once you have received the product and/or service, the only event where you can request a replacement, return, or refund is if the product and/or service does not match the description as mentioned on the Platform. Any request for refund must be submitted within 3 (three) days from the date of the Transaction, or such number of days as prescribed on the Platform, which shall in no event be less than three days.
How to Request a Refund
A User may submit a claim for a refund by contacting us at support@giftbooks.co.in and providing a clear and specific reason for the refund request, including the exact terms that have been violated, along with any proof or photographic evidence required. Whether a refund will be provided will be determined by us, and we may ask for additional details before approving any requests.
Platform-Specific Conditions
- •Before Printing: You may cancel your order and receive a full refund any time before printing begins (typically within 24 hours of payment verification).
- •After Printing Starts: Once printing begins, cancellation is not possible. If a printing defect is present, we will reprint and reship at no cost.
- •Damaged in Transit: Report within 48 hours of delivery with photographic evidence. We will arrange a replacement shipment.
- •Personalized Products: As storybooks are personalized, refunds for change of mind after printing has started are not available.
Refund Processing: Approved refunds are processed to the original Payment Instrument within 5–7 business days.
10. Prohibited Actions
The Platform may not be used in connection with any commercial endeavors except those specifically endorsed or approved by us. As a User of the Platform, you agree not to:
- •Systematically retrieve data or other content from the Platform to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from us.
- •Make any unauthorized use of the Platform, including collecting usernames and/or email addresses by electronic or other means for sending unsolicited email, or creating accounts by automated means or under false pretenses.
- •Circumvent, disable, or otherwise interfere with security-related features of the Platform.
- •Trick, defraud, or mislead us and other Users, especially in any attempt to learn sensitive account information such as passwords.
- •Engage in any automated use of the system, such as using scripts to send comments or messages, or using data mining, robots, or similar data gathering and extraction tools.
- •Interfere with, disrupt, or create an undue burden on the Platform or the networks or services connected to the Platform.
- •Attempt to impersonate another user or person or use the username of another user.
- •Use any information obtained from the Platform to harass, abuse, or harm another person.
- •Decipher, decompile, disassemble, or reverse engineer any of the software comprising or making up a part of the Platform.
- •Upload or transmit viruses, Trojan horses, or other material that interferes with any party's use and enjoyment of the Platform or modifies, impairs, disrupts, or interferes with its operation.
- •Use the Platform in a manner inconsistent with any applicable laws or regulations.
11. Guidelines for Reviews
When posting a review on our Platform, you must comply with the following criteria:
- •You should have firsthand experience with the product/service being reviewed.
- •Your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language.
- •Your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability.
- •You may not post any false or misleading statements.
- •You may not organize a campaign encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews in our sole discretion. By posting a review, you grant us a perpetual, non-exclusive, worldwide, royalty-free license to reproduce, modify, translate, display, perform, and/or distribute all content relating to that review.
12. Limitation of Liability
To the extent permitted by law, GiftBooks shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, even if advised of the possibility of such damages. Our liability is limited to the Transaction Amount you paid for the relevant order.
The User shall indemnify and hold harmless GiftBooks and its affiliates, agents, and representatives from and against any and all claims, demands, causes of action, obligations, liabilities, losses, damages, injuries, costs, and expenses incurred or sustained by reason of or arising out of any breach or alleged breach of any of the terms herein by the User.
We expressly disclaim all liabilities that may arise as a consequence of any unauthorized use of a User's Payment Instrument. We shall not be liable for any loss or damage arising directly or indirectly due to the decline of authorization for any Transaction, malfunction, errors, and/or unscrupulous activities by third parties.
13. Disclaimer
Upon initiating a Transaction, you as a User are entering into a legally binding and enforceable contract with us to purchase the products and/or services, and you shall pay the price as listed on the Platform through legitimate and legal sources of funds and through the accepted Payment Instruments.
You shall provide accurate payment details to the secure payment system for making purchases on the Platform. The information provided by you may be utilized or shared with any third party if required in relation to fraud verification or by law, regulation, or court order.
If you receive a User identification code, Order ID, password, or any other piece of information as part of our security procedures, you must treat such information as confidential. You must not disclose it to any third party.
The content on our Platform is provided for general information only. Where our Platform contains links to other websites and resources provided by third parties, such links are provided for your information only and should not be interpreted as approval by us of those linked websites. We do not guarantee that our Platform will be secure or free from bugs or viruses. You are responsible for using your own virus protection software.
14. Governing Law & Dispute Resolution
These Terms, their subject matter, and their formation are governed by the laws of India. You and we both agree that the courts of India will have exclusive jurisdiction over any dispute.
Any dispute or claim arising out of or in connection with these Terms or their breach, termination, or invalidity (“Dispute”) shall be referred to and finally resolved by arbitration in Bengaluru in accordance with the Arbitration and Conciliation Act, 1996, which rules are deemed to be incorporated by reference herein.
Within 30 (thirty) days of the issue of a notice of Dispute, the parties shall mutually agree on the appointment of a sole arbitrator. If such mutual agreement is not reached within 30 days, the arbitrator shall be appointed in accordance with the Arbitration and Conciliation Act, 1996. The seat of arbitration shall be India and proceedings shall be conducted in the English language. The decision of the arbitrator shall be final and binding on all parties.
Consent to arbitration shall not preclude either party from seeking suitable injunctive relief from courts in Bengaluru in appropriate circumstances. Each party shall initially bear its own cost for arbitration, to be reimbursed as directed in the arbitral award.

16. Changes to These Terms
GiftBooks reserves the right to modify these Terms at any time by posting updates to the Platform. Changes are effective immediately upon posting. Your continued use of the service constitutes acceptance of the modified Terms. You are advised to review these Terms periodically.
17. Story & Data Retention
Story Retention Period: Personalized stories and their associated AI-generated illustrations created on the Platform are retained on our servers for a period of 3 (three) months from the date of creation. After this period, stories and their illustration files may be permanently removed from our systems without further notice.
Your Responsibility: We strongly recommend that you download and save a copy of your story and all illustrations before the 3-month retention period expires. GiftBooks shall not be liable for any loss of story data or illustrations after this period.
Printed Books: The 3-month retention policy applies to digital copies of your story stored on our Platform only. It does not affect the physical printed book, which is yours to keep permanently once delivered.
Earlier Deletion: You may request the deletion of your story data at any time before the 3-month period by contacting us at support@giftbooks.co.in. We will process such requests within 7 business days, subject to any legal obligations requiring us to retain certain data.
Account Deletion: If you request deletion of your account, all associated story data and illustrations will be permanently removed within 30 days of the request, consistent with our Privacy Policy.
